Social Security Disability Overpayment

If you receive social security disability or SSI disability benefits and are found to have an overpayment, consider doing the following:

Visit your local social security office to learn what created the overpayment. If the overpayment was caused by computational errors, or work or entitlement issues, you should complete a request for waiver to have collections stopped.

Be sure you are prepared to do your waiver, i.e. bring in receipts for power, gas, electric, water and rent. Also, be prepared to verify what you have as income or have in a checking or savings account. Other factors that may be taken into consideration are estimates for clothing and car repair expenses.

The waiver request process mirrors the disability evaluation process. The first step is the completion of a request for waiver. If this is denied, a pesonal conference may be held. Lastly, a benefit recipient may request a hearing before an administrative law judge to have the overpayment issue addressed.

One piece of advice (from a current SSA claims rep): at the personal conference, make a payment arrangement with SSA to avoid total collection of the debt, i.e. having your checks completely cut off.
